ARTICLE 145, FEDERAL CONSTITUTION: THE UNFETTERED DISCRETION UNDER THE RULE OF LAW

The Malaysian Bar or generally known as the Bar Council, has recently passed a motion to call for Tan Sri Mohamed Apandi Ali, the current Attorney General (“AG”) to resign permanently. The underlying justification echoed by the Malaysian Bar for its motion, revolves around the controversial news of 1MDB. The Bar viewed that it is in the position to protect the sanctity of the administration of justice, and thus had acted benevolently in the interest of the nation.

Mahkamah Tinggi Benar Tangguh Prosiding Tuntutan Saman Terhadap Presiden, Setiausaha Kerja UMNO

KUALA LUMPUR, 1 Okt –  Mahkamah Tinggi Kuala Lumpur hari ini telah membenarkan permohonan penangguhan segala prosiding berhubung tuntutan yang difailkan oleh  Anina Saadudin terhadap Presiden UMNO, Datuk Seri Najib Tun Razak dan Setiausaha Kerja UMNO Malaysia, Datuk Ab Rauf Yusoh.
Menurut peguam Datuk Hafarizam Harun yang mewakili Datuk Seri Najib Tun Razak dan Datuk Ab Rauf Yusoh, alasan penangguhan prosiding ialah kerana terdapatnya keadaan istimewa di mana sekiranya tidak ditangguhkan prosiding itu boleh memberikan kesan kepada permohonan Datuk Seri Najib dan Datuk Ab Rauf Jusoh untuk mengenepikan kes yang difailkan oleh wanita tersebut.

PAP Is Facing Tough Challenge Just Like BN Had Faced Before-An Adaptation Article

In Malaysia, politics is 24/7.  Here, it is much less so, but it goes into overdrive for about two weeks every 4-5 years when GE is called.  PAP leaders are better at governing than campaigning, whereas Workers Party and SDP's Chee Soon Juan excel in it.

Looks like WP will keep what they have.  And they might get East Coast GRC and Fengshan (single seat).  Chee Soon Juan's SDP might win Holland-Bukit Timah GRC but probably less likely than East Coast.  According to our bookies :p

Court Directive For Pm To File Defence Statement Is Accepted Practice

There is nothing unusual or obscure about a high court directive for Prime Minister Datuk Seri Najib Tun Razak to file his statement of defence in a civil suit as it has been an accepted practice all along.

His lawyer, Datuk Mohd Hafarizam Harun said in any civil suit, the defendants had the statutory right to respond or reply to a suit.

Yesterday, the high court instructed Najib and three others to file their statement of defence in relation to a suit by the opposition for alleged overspending in the 13th General Election campaign.
               
The court instructed Najib to file his statement of defence on or by Oct 1.

Resolution regarding retired judges of the superior courts appearing as counsel in court

(A) WHEREAS it is a fundamental principle of the Malaysian legal system that not only must justice be done, it must be seen to be done; thus perceptions and appearances matter.

(B) WHEREAS it is a principle of antiquity in common law jurisdictions that a retired judge of a superior court should not practice as counsel before the judges who were previously his colleagues or his junior to him on the Bench.

(C) WHEREAS that tradition and convention was likewise observed in Malaysia for decades, until in recent years.

(D) WHEREAS retired judges now frequently appear as counsel, not only in the superior courts, but also in the subordinate courts and even to argue chamber applications.

Situasi Terengganu Berbeza Krisis Perak 2009

KUALA LUMPUR, 13 Mei - Kemelut pemerintahan yang berlaku di Terengganu tidak boleh disamakan dengan situasi peralihan kuasa di Perak pada tahun 2009 yang menyaksikan Barisan Nasional (BN) mengambil alih tampuk pemerintahan daripada Pakatan Rakyat (PR).

Pengamal undang-undang yang dihubungi Bernama hari ini, berpendapat BN kekal memerintah di Terengganu walaupun tiga wakil rakyatnya dari Umno mengisytiharkan diri mereka sebagai calon Bebas, kerana tidak menyatakan pendirian untuk menyokong pembangkang.

Peguam Datuk Mohd Hafarizam Harun berkata keadaan ini berbeza daripada krisis Perak 2009 apabila tiga wakil rakyat PR menjadi ahli Bebas menyatakan sokongan kepada BN, tatkala BN dan PR kekika itu mempunyai jumlah kerusi yang sama iaitu 28 dalam Dewan Undangan Negeri (DUN) yang berjumlah 59 kerusi.
